Why is there a staged approach to implementing Trading Permits?

The staged approach allows the City to trial and refine the Trading Permit system to ensure it meets community needs, supports local businesses, and encourages activation of public spaces. This method enables feedback collection and adjustments before full implementation, ensuring fairness and sustainability.

Traders operating on City-owned or managed land will have until 1 December 2025 to submit a Trading Permit application. After this date, anyone trading without a valid permit may be issued an infringement in accordance with the City’s local laws.

Why are Trading permits only being issued up to 30 September 2026?

This date marks the end of the initial trial period. Limiting permits to this timeframe ensures that any changes made after the trial are fair and equitable for all Traders.

Why is Trading excluded from the Geraldton & Beresford Foreshore?

The Geraldton and Beresford Foreshores present unique challenges due to existing lease and licence agreements. A tailored and strategic framework will need to be developed in collaboration with Council and the community to:

  • Ensure equitable access
  • Enhance community and tourism outcomes
  • Foster innovation
  • Align with the City’s Corporate Business Plan 2025–2029

Existing lease and licence arrangements will remain in place, with a formal review planned within the next 12 months. The initial rollout in other areas will also serve as a valuable opportunity to reflect, gather insights, and identify improvements that can inform the development of a tailored approach for the foreshore precincts.

How can I Trade on private property not owned by the City?

Trading on private property requires permission from the landowner and may also require development approval from the City, depending on the nature of the activity. Contact the City’s Town Planning team on 9956 6600 for guidance on zoning and compliance requirements.

Can I trade in multiple City locations with one permit?

Yes. Each Trading Permit allows for up to three approved trading locations. Permits provide nonexclusive use of public open space, meaning that at times an approved location may not be available due to functions or other activities. In such cases, traders are encouraged to operate from one of their alternative approved locations.

What types of trading activities are permitted?

Permitted activities may include mobile food vans, market stalls, pop-up retail, and other temporary commercial services. Each application is assessed individually to ensure it aligns with the City's goals for public space activation and community benefit.

What are the fees?

To encourage activation and uptake, no Trading Permit fee will be charged for the first 12 months, until 1 September 2026. After this period, permit fees may apply.

  • Application Fee: $220.00 (inc. GST) applies and must be paid when submitting your application.

What if I pay the Permit Application fee and my application is declined?

If your permit application is unsuccessful, the City will work with you to explore alternative locations. Should no suitable alternatives be found and the application cannot be approved, you will be eligible for a 50% refund of the application fee.

How will permit applications be assessed?

Applications are assessed based on suitability of the proposed location, competition with existing businesses and condition and appearance of the trading vehicle or setup. The City’s internal review panel includes officers from:

  • Maintenance Operations
  • Parks
  • Sports & Leisure
  • Environmental Health
  • Town Planning
  • Ranger Services

How will I know if my permit is temporarily suspended for an event?

Traders affected by temporary suspensions will be notified via email using the address provided in their application form.

What happens if I breach the permit conditions?

Breaches may result in warnings, suspension, or cancellation of your permit. Serious or repeated breaches may affect future applications.

Do I need public liability insurance?

Yes. All traders must hold current public liability insurance with a minimum cover of $10 million. Proof of coverage must be submitted with your Trading Permit application.
